These terms and conditions stipulate the general rights and responsibilities of SMI Group OÜ, company registration number 12517949, located in Viru väljak 2, Tallinn 10111, Estonia (hereinafter referred to as “Aufort”), and the client (hereinafter referred to as “C”).
1. General terms and conditions
1.1 Hereby, “C” confirms that they have read, understood and agreed to the contents of these terms and conditions.
1.2 Hereby, the parties confirm their awareness that “Aufort” cannot give any guarantees regarding income or profit from purchasing the products or services offered by “Aufort”.
2. General rights and obligations of “C”
2.1 “C” has the right to purchase “Aufort” products and services for the prices and according to the terms and conditions displayed on the “Aufort” website at www.aufort.gold.
2.2 “C” agrees that the information (name, national identification number, address and other personal data) provided for “Aufort” is correct.
2.3 “C” is obliged to immediately inform “Aufort” of any and all changes in their personal data.
2.4 “C” agrees that “Aufort” can use their provided contact data for marketing and administrative purposes.
3. General rights and obligations of “Aufort”
3.1 “Aufort” is obliged to provide correct information about all products and services offered by “Aufort” upon advertising and delivery.
3.2 “Aufort” is not allowed to publish the personal data or other information belonging to “C” to third parties (except in cases that are in accordance with law).
4. Prices and payments
4.1 “C” is obliged to pay for the ordered products and services the price given on the “Aufort” website.
4.2 The payment for an order must be made immediately after confirming the order.
4.3 Should “C” fail to make a payment according to paragraph 4.2, “Aufort” has the right to demand an interest of 0.5% from the price of the product for each day of delay.
4.4 “Aufort” reserves the right to cancel the order or change prices if necessary.
4.5 For precious metal products sold by “Aufort”, the 14-day right to withdraw from the purchase does not apply in accordance with clause 53 (4) 1¹) of the Law of Obligations Act of the Republic of Estonia, which provides that the 14-day right of withdrawal does not apply to contracts entered into for the provision of financial services where the price is dependent on fluctuations in the financial market which cannot be controlled by the trader, including to contracts the object of which are services related to foreign currency or the securities specified in § 2 of the Securities Market Act.
5. Transport and liability
5.1 All orders sent by “Aufort” are insured. Shipment insurance is an integral part of the transport service. The insurance premium is 0.5% of the value of the goods, which is displayed on a separate line in the shopping cart.
5.2 If goods are damaged or lost during transport, “Aufort” reserves the right to decide whether to resend the products or refund the purchase price to the customer. All shipments are insured until the customer receives the order.
5.3 In case of any complaints, please immediately (on the day of receipt of the order) contact “Aufort” Customer Service email@example.com. Later claims are not met.
5.4 When collecting an order in person, we ask that you come within 5 business days of our notification. Starting on the 6th day, a daily holding charge of 0.1% of the product’s value, or a minimum of €1/day will be applied.
5.5 Unsuccessful delivery by courier or transport: if the recipient was unavailable, did not answer a phone call, declined receipt of the package, or if there was an incorrect address, “C” will be responsible for paying for each subsequent delivery attempt.
